Matthew Myers recently obtained approximately $2 million dollars in property on behalf of his client following a probate court bench trial for his client’s elective share claim. This represented the full amount of the claim after the personal representative had attempted to argue that the claim was already fully satisfied. Mr. Myers also obtained favorable rulings on each of the other issues at hand, including the desired partition of property to fund the elective share claim, the reimbursement of a bequest that the personal representative had liquidated, and the construction of a will provision that the personal representative argued provided additional property to her children.
