Summary Judgment Obtained

SWB partner Ryan Holt recently obtained summary judgment for a retailer in a premises liability case. The plaintiff alleged that she sustained significant injury after a shopping cart bumped into her lower back. However, her treating and testifying physician failed to causally connect the incident with the significant injuries she claimed. The court ruled that the plaintiff’s set of facts presented a unique situation with “highly complex and technical evidence” requiring an expert witness to attest to causation, and granted summary judgment for the retailer.
